How Do We File as a Homeschooling Family?

Q: Our homeschool family travels a lot. How do we comply with the homeschool law?

A: It is generally understood that parents should comply with compulsory attendance laws of the state they are in for 6-8 weeks or more. It does not matter where the parents declare residency or pay taxes. The question is, “Where does the child sleep at night?”

For example, parents could be a resident of another state or live in another country, but they would need to comply with Virginia’s compulsory attendance laws if they are in Virginia for 6-8 weeks or more.

HEAV can not give legal advice. Be sure to seek appropriate legal counsel for your specific situation to ensure you comply with state laws as you travel.
